Introduction and Acceptance

These terms and conditions ("Terms") govern your use of the website easy.patsatech.com (the "Site") operated by EasyCooling ("EasyCooling", "we", "us" or "our"), and any quotation, booking, or contract for the supply and installation of air conditioning equipment, or for related servicing, that you enter into with us. By submitting a quotation request, accepting a quotation, or confirming a booking, you agree to be bound by these Terms. If you do not agree to these Terms, you should not proceed with a quotation request or booking.

Where you are entering into a contract with us on behalf of a business, you confirm that you have authority to bind that business to these Terms, and references to "you" in a commercial context refer to that business.

Definitions and Interpretation

"Contract" means the agreement formed between you and EasyCooling for the supply of goods and installation services, comprising your accepted quotation, our booking confirmation, and these Terms.

"Goods" means the air conditioning units, pipework, and associated equipment supplied and installed as part of the services.

"Services" means the survey, supply, installation, commissioning, and any servicing work carried out by us or on our behalf.

"Quotation" means a fixed or indicative price provided through our online quotation tool or by an EasyCooling representative.

"Working day" means any day other than a Saturday, Sunday, or public holiday in England and Wales.

Headings in these Terms are for convenience only and do not affect interpretation.

About Our Services

EasyCooling supplies and installs residential split-system, multi-room, and commercial air conditioning systems across London and the South East, and offers optional annual servicing. Our online quotation tool provides a fixed, VAT-inclusive indicative price for standard installations based on information you supply about your property. All quotations are subject to confirmation in accordance with section 5 below.

Eligibility and Accuracy of Information

By requesting a quotation, you confirm that you are at least 18 years of age, that you have the legal right to authorise works at the property in question (whether as owner, tenant with landlord consent, or authorised occupier), and that the information you provide to us, including property details, access arrangements, and contact information, is accurate and complete to the best of your knowledge. We rely on this information in preparing quotations and are not responsible for inaccuracies in pricing or scheduling that result from incomplete or incorrect information you have provided.

Quotations and Pricing

Online quotations are estimates generated from the answers you provide regarding property type, room dimensions, access, and preferred equipment location.

Quotations are indicative until confirmed following any pre-installation survey or on-site verification carried out by our engineer.

Where access, electrical supply, structural conditions, pipe run distances, or planning constraints differ materially from the information originally provided, we will notify you in writing of any resulting price variation before proceeding, and you will have the opportunity to accept the revised price or withdraw without charge, save for any costs already reasonably incurred with your knowledge.

Unless expressly stated otherwise, all prices quoted are inclusive of VAT at the prevailing United Kingdom rate and include standard installation labour for the specific package described.

A quotation remains valid for the period stated at the point of issue or, where no period is stated, for 30 days from the date of issue, after which it may be subject to review.

Promotional pricing, seasonal offers, and finance arrangements apply only where expressly stated and may be subject to additional eligibility criteria communicated at the time.

Booking, Deposits and Payment

A booking is confirmed only once you have accepted a final quotation and, where applicable, paid any required deposit or booking fee.

We will agree a proposed installation date with you in writing. Installation dates may occasionally need to be rescheduled due to adverse weather, restricted site access, equipment supply delays, or engineer availability; we will notify you as soon as reasonably practicable and agree an alternative date.

Any balance of the price is due as set out in your booking confirmation, and in the absence of a specific term, is payable on or before completion of the installation, unless a separate finance agreement applies to your order.

We accept the payment methods displayed at checkout or otherwise communicated to you at the time of booking.

If a payment is declined, reversed, or otherwise fails, we reserve the right to treat your booking as cancelled and to release the reserved installation slot, without prejudice to any other rights we may have.

Consumer Finance

Where we offer 0% or other promotional finance in connection with an order, that finance is provided by an independent, third-party lender and is subject to status and affordability checks conducted by that lender. EasyCooling acts only as a credit broker in this context and is not the lender. The finance agreement is a separate contract between you and the lender, governed by the lender's own terms, including its own cancellation and cooling-off provisions, and any queries relating to a finance agreement should be directed to the relevant lender in the first instance. Your obligations to EasyCooling under these Terms and any obligations you owe under a separate finance agreement are independent of one another.

Cancellation and Rescheduling

You may reschedule a confirmed installation date by giving us at least 48 hours' notice, subject to availability of an alternative date.

If you cancel a booking after equipment has been specifically ordered for your installation, or at short notice once an engineer visit has been scheduled, we reserve the right to charge or retain a reasonable amount reflecting costs we have already incurred, including any manufacturer restocking fee.

If you are a consumer and you enter into the Contract at a distance, for example online or by telephone, you may benefit from a 14-day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This right does not apply once installation work has begun at your express request and with your acknowledgement that the cancellation right will be lost, and does not apply to goods made or adapted to your specification. We will explain how this cancellation right applies to your specific order before installation work begins, and you will be asked to confirm your instructions in writing where you wish work to start within the standard cancellation period.

Your Responsibilities

In order for us to carry out the Services safely and efficiently, you agree to the following.

  • Provide accurate and complete information at the quotation and survey stages.
  • Ensure safe and reasonable access to the property on the agreed date, including parking arrangements or permits where required in your area.
  • Obtain, prior to installation, any necessary landlord, freeholder, management company, planning, or listed building consent required for the works.
  • Ensure that a suitable and safe electrical supply is available, as confirmed at survey.
  • Keep children, pets, and vulnerable persons away from work areas for the duration of the installation for their own safety.
  • Notify us promptly of any change of circumstance that may affect the scope or safety of the installation.

Installation Standards

All installation work is carried out by F-Gas certified engineers in accordance with the relevant manufacturer instructions, the F-Gas Regulations, and other applicable building, electrical, and health and safety regulations.

Standard installation includes mounting of indoor and outdoor units, refrigerant pipework within the limits specified in your quotation, condensate drainage, electrical connection to an existing suitable supply, and system commissioning, including a vacuum test.

Additional works, including but not limited to extended pipe runs, additional electrical circuits, scaffolding or specialist access equipment, or making good beyond minor and incidental drilling touch-ups, are not included in the standard price and will be quoted separately before being carried out.

We will remove all packaging and installation waste and leave the work area in a clean and tidy condition. Any redecoration beyond minor touch-ups remains your responsibility.

Warranties and Guarantees

Equipment supplied is covered by the relevant manufacturer's warranty, provided the equipment is registered in accordance with the manufacturer's process. Warranty periods and terms vary by brand and model and will be confirmed at the point of booking.

In addition to the manufacturer warranty, EasyCooling provides a workmanship guarantee covering defects in installation for a period of 12 months from the date of completion.

Neither the manufacturer warranty nor our workmanship guarantee covers damage or malfunction resulting from misuse, failure to carry out recommended servicing, unauthorised modification, or failure to follow the manufacturer's operating instructions.

Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, including the right to services carried out with reasonable care and skill, within a reasonable time, and for a reasonable price where not agreed in advance, and the right to goods that are as described, of satisfactory quality, and fit for purpose. Where any provision of these Terms would otherwise conflict with a right that cannot lawfully be excluded or limited, that statutory right prevails.

Intellectual Property

All content on the Site, including text, graphics, logos, quotation tool functionality, and underlying software, is owned by or licensed to EasyCooling and is protected by copyright, database, and other intellectual property rights. You may view and use the Site for the purpose of obtaining a quotation or managing your booking, but you may not reproduce, distribute, or create derivative works from any part of the Site without our prior written consent.

Acceptable Use of the Site

You must not misuse the Site, including by attempting to gain unauthorised access to our systems, introducing malicious code, submitting false or fraudulent information, or using automated means to scrape or extract data from the Site without our permission. Content published on the Site, including guidance on system sizing or running costs, is provided for general information only and does not constitute professional advice on planning permission, building regulations, or electrical installation, on which you should seek independent advice where relevant.

Limitation of Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded under the laws of England and Wales.

Subject to the foregoing, our total aggregate liability to you arising out of or in connection with a single installation Contract, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid by you to us under that Contract. We shall not be liable for any indirect or consequential loss, including loss of profit, loss of business opportunity, or business interruption, whether arising in contract, tort, or otherwise, and whether or not such loss was foreseeable.

Indemnity

You agree to indemnify and hold EasyCooling harmless against any reasonably foreseeable loss, cost, or expense arising from inaccurate information you have provided, from your failure to obtain a necessary third-party consent for the installation, or from your breach of these Terms, save to the extent that any such loss arises from our own negligence or breach of Contract.

Force Majeure

We shall not be in breach of these Terms nor liable for any delay in performing, or failure to perform, any of our obligations if such delay or failure results from events, circumstances, or causes beyond our reasonable control, including but not limited to extreme weather, supply chain disruption, strikes, or governmental restrictions. In such circumstances, our obligations will be suspended for the duration of the event, and we will use reasonable endeavours to resume performance as soon as reasonably practicable.

Complaints and Dispute Resolution

If you are unhappy with any aspect of our Services, please contact us in the first instance via the details on our Contact page at easy.patsatech.com/contact. We aim to acknowledge complaints within two working days and to provide a substantive response within 14 working days. Where we are unable to resolve a complaint to your satisfaction, you may be entitled to refer the matter to an alternative dispute resolution provider, or to seek guidance from Citizens Advice or Trading Standards.

Data Protection

Our collection and use of personal data in connection with quotations, bookings, and the operation of the Site is described in our Privacy Notice, available at easy.patsatech.com/privacy, which forms part of these Terms by reference.

General Provisions

20.1 Entire Agreement

These Terms, together with your accepted quotation and booking confirmation, constitute the entire agreement between you and EasyCooling in relation to their subject matter, and supersede any prior representations, discussions, or understandings, whether written or oral, except that nothing in this clause excludes liability for fraudulent misrepresentation.

20.2 Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or, if that is not possible, shall be severed, and the remaining provisions shall continue in full force and effect.

20.3 Assignment

You may not assign, transfer, or subcontract any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to another organisation, provided that this does not materially affect your rights under the Contract.

20.4 Waiver

No failure or delay by either party in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy, nor shall any single or partial exercise of a right or remedy prevent any further exercise of that or any other right or remedy.

20.5 Third-Party Rights

Save as expressly stated, a person who is not a party to the Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.

20.6 Notices

Any notice given under these Terms shall be in writing and shall be delivered by hand, sent by pre-paid post, or sent by email to the address or email address notified by the relevant party for that purpose.

Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, save that if you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in the courts of your place of residence.
